Globie Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you (“you” or “User”) and Globie, Inc., a Delaware corporation (“Globie,” “we,” “us,” or “our”), governing your access to and use of our website, apps (if any), and prepaid eSIM data plans and related services (collectively, the “Service”).
By purchasing, installing, activating, or using a Globie eSIM, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Globie provides prepaid eSIM data plans that allow compatible, unlocked devices to access mobile data networks via partner carriers. Unless explicitly stated otherwise, Globie plans are data-only and do not include voice calling or SMS.
2. Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. If you use the Service on behalf of an entity, you represent you have authority to bind that entity.
3. Account, Security, and Communications (if applicable)
If you create an account, you agree to provide accurate information and keep it updated. You are responsible for all activity under your account and for safeguarding login credentials and any eSIM delivery details (including QR codes).
You agree we may contact you electronically (email or other reasonable means) regarding purchases, delivery, support, and service updates.
4. Device Compatibility & Requirements
You are responsible for ensuring your device is:

unlocked

eSIM-compatible
-
compatible with local networks for your destination
Globie is not responsible for incompatibility caused by your device, your home carrier restrictions, or incorrect setup.
5. Purchase, Delivery, Installation, and Activation
When you purchase a plan, you authorize us (or our payment processor) to charge the displayed amount, including applicable taxes.
Your eSIM is delivered digitally (typically via email and/or your account). Activation occurs when you install the eSIM and/or enable it in your device settings, or otherwise begin using data through it.
Once activated, the Service has started.
6. Plan Duration, Expiration, and Data Usage
Each plan has:

a data allowance, and
-
a validity period
Your plan ends when the data is fully used or the validity period expires, whichever happens first. Unused data does not roll over unless explicitly stated.
Data usage may be measured and billed according to network reporting and may be subject to rounding or session accounting by carriers.
7. Coverage, Speeds, and Availability
Coverage, speeds, and service quality vary by destination and depend on third-party carrier networks and conditions. Speeds are not guaranteed and service may be limited, interrupted, throttled, or unavailable in some areas (including remote locations) due to factors outside our control.
8. Acceptable Use
You agree not to:

use the Service for unlawful, fraudulent, or abusive activity

resell, redistribute, or commercially exploit the Service

interfere with network operations, engage in network manipulation, or use automated traffic patterns inconsistent with normal consumer use
We may suspend or terminate Service for suspected abuse or violations of these Terms.
9. Top-Ups and Extensions (if offered)
If available, you may purchase additional data (“top-ups”) or extend validity. Top-ups apply to the same eSIM and do not require reinstallation. Availability of top-ups varies by destination and plan.
10. Refund Policy
Unactivated plans: If an eSIM plan has not been activated, you may request a refund, subject to verification and applicable law.
Activated or used plans: If a plan has been activated or used, refunds are generally not available, except where required by applicable law. In limited cases, we may consider partial refunds at our discretion based on remaining unused data and plan status.
We may refuse refunds in cases of suspected fraud, abuse, repeated refund requests, chargeback abuse, or violations of these Terms.
Refund requests must be submitted to support@globie.com and may take up to 10 business days to process (timing can vary by payment method).
11. Payments, Taxes, and Chargebacks
All prices are shown at checkout. You are responsible for any taxes or fees imposed by your jurisdiction unless explicitly included.
If you initiate a chargeback without first contacting us to resolve the issue, we may suspend your access while we investigate and respond to the dispute. We reserve the right to provide relevant account and transaction information to our payment processor in connection with dispute resolution.
12. Intellectual Property
Globie and its logos, designs, and site/app content are owned by Globie or its licensors and protected by intellectual property laws. You may not copy, reverse engineer, or exploit the Service except as expressly permitted.
13. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, Globie disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee uninterrupted service, specific coverage, or specific performance.
Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.
14. Limitation of Liability
To the maximum extent permitted by law:

Globie will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits, revenue, data, or goodwill.

Globie’s total liability for any claim arising out of or relating to the Service will not exceed the amount you paid for the plan that gave rise to the claim.
Some jurisdictions limit liability exclusions, so these limitations may not apply to you in full.
15. Indemnification
You agree to indemnify and hold harmless Globie and its officers, directors, employees, and partners from claims arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party rights.
16. Suspension and Termination
We may suspend or terminate the Service if you violate these Terms, engage in fraud or abuse, or if required by law or our network partners. Suspension or termination may occur without notice where necessary to prevent harm or fraud.
17. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. Updated Terms will be posted on our website with a revised “Last updated” date. Continued use after changes become effective constitutes acceptance.
18. Governing Law; Dispute Resolution; Class Action Waiver
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law principles.
Informal resolution: Before filing a claim, you agree to contact us at support@globie.com with a brief description of the issue and the relief requested. We will try to resolve it informally.
Venue: Any dispute not resolved informally will be brought in the state or federal courts located in Delaware, and you consent to jurisdiction there.
NO CLASS ACTIONS: You and Globie agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class or representative proceeding.
19. Export and Sanctions Compliance
You agree not to use the Service in violation of U.S. export controls or sanctions laws, including restrictions administered by the U.S. Department of Treasury (OFAC). You represent you are not located in, or ordinarily resident in, a sanctioned jurisdiction where use would be prohibited.
20. Miscellaneous
Severability: If any provision is unenforceable, the remaining provisions remain in effect.
Assignment: You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset sale.
Entire agreement: These Terms and any referenced policies constitute the entire agreement regarding the Service.
